FAQ's

 

Do I need a Process Server?

 

Whether or not you need a process server depends on your specific case and the laws governing your case in your state and municipality. In more serious cases (that is, cases involving larger sums of money than what amounts to “small claims”) or when you are subpoenaing someone to appear in court, you may need a process server.

If you are not sure, contact your attorney or a local process-serving agency to determine the specifics of your case. Process servers are often well-versed in which cases require their services, and they can help to point you in the right direction. Failing to use a process server when you need one can delay your case, or worse, your case could be thrown out on procedural grounds.

The purpose of a process server is to make sure the defendant is notified and given the chance to come to court and offer a defense. The U.S. Constitution requires that no defendant be deprived of life, liberty, or property without due process of the law, and making sure a defendant is aware of the fact that he or she has to come to court is an important part of due process. If the defendant is properly served and knows they are supposed to come to court, and does not show up, the plaintiff can get a default judgment against the defendant (in other words, they can be declared the automatic winner). Thus, process servers perform the important function of protecting defendants’ rights.

 

What are the benefits of using a process server from ARS?

 

You deal directly with your process server, who will be going straight to the person or company who is going to be served. You will save time and money, and you will have direct communication regarding your serves also should you have questions regarding the status of your service.

Additionally, every process server here at ARS has 5 years or more of process serving experience.

 

How much does it cost to get papers served?

 

The cost of routine service can range anywhere from $47 – $200. Prices range depending on the location of your serve. If the serve becomes difficult, you may expect to pay more. You may incur additional skip tracing fees if you need the person located, or if additional attempts are required. If you have a rush serve or you need papers served the next day or on a holiday you can expect to pay a slightly higher fee.

How long does it take to get papers served?

Turn-around-time can vary from case to case. With ARS your serve if received before 11 am MST will dispatch out within 72 hours. However, this is something that can be determined in most cases by you, which usually leads to a higher cost.

These are the following speeds of service we offer:

  • Same Day Service (first attempt  that same day if documents are received by 11 am MST)

  • Rush Service (first attempt made within 4 hours of receiving your documents)

  • Routine Service (first attempt made within 72 hours)
