Frequently Asked Questions

How do I get started?

The fastest way to get your documents to us is by email. Our email is arsnewmexico@gmail.com or mailed to our office at 2801 West Missouri Avenue Artesia New Mexico, 88210. 

Once your documents are received we will let you know and place them in line for dispatch. We will keep you updated on the status of your serve via the email that we received your documents unless otherwise directed. Once service is complete we will send you an invoice. Through the invoice, you have the option to pay with a credit card. Service must be paid in advance if you are a private citizen.  

(Law firms, state or company entities are not required to pay in advance) 

How many attempts do I get?

Within Eddy County, you will receive three attempts. A morning, afternoon, and weekend attempt. Outside Eddy County, you will receive two attempts. An afternoon and evening attempt. Each attempt will be sent to your email as a Process Server Snapshot. The Snapshot will include a picture, GPS location, and the result of the attempt.

What are an Affidavit of Service and a Proof of Service?

An Affidavit of Service also called a Proof of Service, is a signed document provided to you by ARS upon completion of serving your documents. Proof of Service states when, where, and who was served. There are a number of other affidavits that can be provided to you as a client. For instance, an Affidavit of Due Diligence may be provided if the person to be served cannot be located.

(Affidavit of Due Diligence must be requested if the serve was unable to be completed)

How long does it take to get papers served?

For standard serves, the typical time to serve papers is 5-10 days.

Turn-around-time (or TAT) can vary from process server to process server. However, this is something that can be determined in most cases by you, which usually leads to a higher cost. Most process servers offer rates for the following speeds of service:

  • Rush Service (first attempt usually within 24 hours)

  • Routine Service (first attempt with 5 days)

(Due to Covid-19 time frame's may vary in highly infected areas)

How can I pay?

Once the first attempt has been completed you will receive an invoice. It is standard company policy and will save you time on receiving the Return of Service. You have the option to pay directly through the invoice using a credit card or mailing us a check. If you pay with a credit card your documents will be emailed to you once the Return of Service is completed. If you pay by check we must receive payment prior to sending the Return of Service.
